\n1.- INTRODUCCION:
\nEsta tarea que doy a conocer como integrante del equipo de colaboradores de
\nesta revista jur\u00eddica cuyo editor me ha concedido este espacio tiene la
\npretensi\u00f3n en un futuro de dar a conocer a trav\u00e9s de esta misma editora un
\ntrabajo de mayor envergadura.
\nDicho ensayo pretende abarcar las pruebas en particular, desde aquellas
\nconsideradas t\u00edpicas, las no t\u00edpicas y las nuevas que han irrumpido en el proceso
\na trav\u00e9s de la innovaci\u00f3n y aparici\u00f3n de nuevas tecnolog\u00edas, sobre todo la
\ninform\u00e1ticas.
\nNuestro digesto procesal ha reglado con cierta holgura solo dos tipos de
\npruebas: la testifical y la pericial; las dem\u00e1s a diferencias de c\u00f3digos procesales
\nde Iberoam\u00e9rica no la mencionan , ni tan siquiera la conocemos en el \u00e1mbito
\njurisdiccional como los seguimientos, pruebas digital, ect; pero es suplida la
\naparici\u00f3n de algunas pruebas bajo el ac\u00e1pite de Libertad probatoria, en dicho
\ncontexto abordo otras pruebas , poniendo \u00e9nfasis en la necesidad de contar con
\nla debida prudencia al momento de determinar si las mismas se las puede
\nincorporar al proceso como acto investigativo propia del Ministerio Publico sin
\nsupervisi\u00f3n jurisdicci\u00f3n o precisa la autorizaci\u00f3n de ese estamento.
\nMi intenci\u00f3n al esbozar esta trabajo tiene una finalidad pr\u00e1ctica, despertar la
\ninquietud de los operadores del sistema en mejorar sus habilidades en el
\nan\u00e1lisis probatorio en el proceso penal y en ese contexto las dificultades no es
\nmenor.
\nSe podr\u00e1 esgrimir teor\u00edas y doctrinas de connotados actores , quienes
\ninvariablemente acuden a los autores cl\u00e1sicos desde Bentham , Carnelutti,
\nChiovenda, Fray Framerino Malatesta entre otros, mencionando a Andr\u00e9s
\nPerfecto Ib\u00e1\u00f1ez, Michael Taruffo, Claira Olmedo, Cafferata Nores , los muy<\/p>\n

citados Hernan Devis Echandia, Adolfo Alvarado Velloso entra tanto otros que
\ndesde la perspectiva del derecho procesal penal nos han dejado valiosos aportes
\nsobre en esta materia que se diferencia del derecho probatorio en que las
\npruebas desde la doctrina estudia sus particularidades, pero existe la imperiosa
\nnecesidad de que las pruebas sean abordadas de manera epist\u00e9mica para que la
\nmisma se constituya en una garant\u00eda para el justiciable.
\nLas dificultades que tropezamos es la ausencia de sistematizaci\u00f3n en el \u00e1mbito
\njurisprudencial de las pruebas en la jurisdicci\u00f3n penal , hasta el momento no se
\nha encontrado definiciones precisa sobre determinadas pruebas y los intentos
\ncontin\u00faan diariamente en la b\u00fasqueda de fallos de diversas instancias que nos
\ndigan como orientarme ante el testimonio de un ni\u00f1o objeto de determinados
\nil\u00edcitos , o determinar por qu\u00e9 hasta el momento una pericia psicol\u00f3gica ante
\npuntuales delitos se encuentra con el obst\u00e1culo de la prohibici\u00f3n de re
\nvictimizaci\u00f3n mencionada en las 100 Reglas de Brasilia.
\nLos extremos aducidos sobre las dificultades de las pruebas desde la \u00f3ptica de
\nsu valoraci\u00f3n encuentran alguna reflexiones de mi parte basado en la
\nexperiencia de 13 a\u00f1os de ejercicio profesional independiente y 23 a\u00f1os como
\nJuez Penal de Sentencia e inicio este ensayo que son los hechos en el proceso
\npenal.<\/p>\n
